In a prior article we reported that in July, 2010 the Pennsylvania Legislature adopted a law that extended until July, 2013 the expiration date of certain permits and approvals related to real estate development.
Before the Pennsylvania Legislature recessed for summer break this year, it extended those permits for another three years, until July, 2016. Based upon the interpretation given by at least one county court to the language of the law, it is possible that the Act may extend such permits beyond July, 2016.
This most recent extension of certain existing permits and approvals was recognition by the Legislature of the continuing weak economy and an attempt to preserve developer’s rights to complete previously approved projects when the economy improves.
